Gigastorage and Princo found guilty in CD-R patent lawsuit

Princo and Gigastorage have infringed on Philips' CD-R patents according to the US court of Appeals for the Federal Circuit (CAFC). The companies were sued by Philips and the court has ruled in its advantage. The companies shipped discs to the United States without paying royalities. 

Both Taiwanese companies are planning to appeal to the US Supreme Court or CAFC's plenary review but both do not suffer big losses wheter or not they will lose this case. Both only ship a small amount of CD-R discs to the United States.

As CD-R is losing importance in the global optical discs market, Gigastorage and Prince will not suffer substantial losses from this lawsuit, local industry experts pointed out. The real impact of this case is that Philips may take a strong stance in negotiating royalty charges for DVD+R/RW discs with Taiwanese makers, these experts emphasized
