Philips introduces new CD-R specs, wins lawsuit


On the Philips CD news site we can read that the company has been busy lately.

Besides bringing out new specifications for the production of CD-Rs, they also report to have won a lawsuit against Princo.

Complaints against Princo and Postech in the USA

In the USA Philips has filed complaints for infringement of Philips patents covering CD-R Disc technology. One complaint has been filed against Princo Corporation of Taiwan and its U.S. based distributor Princo America. A second complaint was filed against Postech Corporation of Taiwan and its U.S. based distributor LEDA distribution.

All CD-R discs manufactured by Postech and Princo infringe upon Philips' essential CD-R disc patents since both companies have not entered into the appropriate patent license agreements with Philips. Consequently, the importation and sale of CD-R discs from Princo and Postech into the United States constitutes infringement of Philips' United States CD-R disc patents.

Philips won lawsuit against Princo in Germany

In its drive to create a level playing field in the CD-R disc manufacturing industry Philips recently obtained a favorable judgment in a lawsuit against the company Princo Digital Disc for importing unlicensed/infringing CD-R discs in Germany. On March 1, 2002, The Mannheim Court of Justice found that Princo indeed is illegitimately making and selling these discs by infringing Philips essential patents on CD-R discs and Princo.

It's good to see that Philips is taking actions against the companies that don't have a license, and more importantly to those that are not working with the standards as Philips has documented them.
