TuneSpark violation GPL mp3 LAME encoder...

TuneSpark CD Maker allows you to create your own audio CDs from your favorite MP3 or other popular audio files. This according to their site. But did they make their own codings?

There was a conversation on irc a few minutes ago about a program called TuneSpark (http://www.papayatech.com/). One of the issues pointed out was that it produced a very similar spectrogram to that of LAME. Upon downloading this program and encoding one of my favorite test clips (drone) I noticed it produced exactly the same artifacts as lame. Upon further inspection it was noticed that encspot says the encoded file is from LAME 3.86. One of the other people on irc searched through the file with a hex editor and confirmed the existence of the LAME 3.86 tag.

Well it looks like that TuneSpark is violating the distribution license of LAME Encoder. This TuneSpark program costs $29.95!!
